The Corporate Manslaughter and Corporate Homicide Act 2007
This is a new act that contains a new offence for convicting organisations. A gross failing in Health and Safety management will result in prosecution. It is expected that the courts will look at the organisations management system and the practices in the organisation.
The penalties suggested include unlimited fines in the order of 2.5% to 10% of annual turnover.
It is widely recognised that certification to BS OHSAS 18001 is recognised as a means of demonstrating compliance with the act by showing that reasonable care has been taken to avoid death and injury.
The introduction of this act could be one reason why certifications to BS OSHAS 18001 have doubled in the last 12 months. ISO 9001:2008 changed and revised
For organisations with established ISO9001 Management Systems the changes from the ISO 9001:2000 standard to the new ISO9001:2008 should not be significant as the revisions simply make clear existing clauses without adding any new requirements.
Organisations seeking certification for the first time will find the changes helpful in interpreting the standard needs.
In either case JAD Associates are happy to assist you in the update of your old ISO9001:200 Management System or the introduction of a new ISO9002:2008 Management System.
The most important changes are
0.1 General. Now requires that: The design and implementation of the quality Management System is influenced by its business environment, changes in that environment or the risks associated with that environment.
6.3 Infrastructure now adds Information Systems to the supporting services in section C.
7.2.1 Determination of requirements related to product now suggests that post delivery activities such as Warranty Provision, Maintenance Services and Recycling or Final Disposition should, when applicable, be included.
7.5.4 Customer Property now includes Personal Data within the clause.
7.6 Control of Monitoring and Measuring Equipment now has a new note added that says “Confirmation of the ability of computer software to satisfy intended application would typically include its verification and configuration management to maintain its suitability for use.
